Article I: Mandatory Acceptance & Deemed Amendments Validity
By accessing the platform, creating an account, authenticating via Google, generating a cryptographic vault, or requesting and using the CashGravity Visa Signature® Card, the User irrevocably agrees to be bound by these Terms of Service.
Article II: Promotional Rewards, Cashback & Perpetual Royalties ("Certain Conditions Apply" · Sustainability Shield)
All cashback (+2.0%), reward points, and referral commissions or royalties (+0.50% lifetime in USDT) are discretionary promotional benefits granted by commercial courtesy of CashGravity Global LLC. The term "perpetual", "lifetime", or "vitalicio" defines temporal continuity while the program remains active and does not constitute vested property rights, equity dividends, or immutable debt obligations.
Article III: Chargeback Immunity & Mandatory Commercial Arbitration
Every transaction authenticated via biometrics (Passkeys, Face ID, Titan M2 Fingerprint), Google Auth, or cryptographic signature constitutes an irrevocable commercial order. The User expressly waives any right to initiate bad-faith bank chargebacks and waives the right to participate in class actions (Class Action Waiver), agreeing to submit any unresolved dispute to binding commercial arbitration.
Article IV: Maximum Aggregate Liability Cap
Services are provided on an "AS-IS" and "AS-AVAILABLE" basis. CashGravity's maximum cumulative aggregate liability to any User shall not exceed the net fees paid by the User during the preceding thirty (30) days or the sum of $100.00 USD, whichever is less.
Article VI: Commercial Confidentiality (NDA), Trade Secrets & Referral Safe Harbor
1. Trade Secrets Protection: The User, Merchant, and Affiliate acknowledge that CashGravity's internal financial architecture—specifically including Merchant Cash Advance (MCA factoring formulas), perpetual affiliate royalty points (+0.50% lifetime USDT splits), and fee margin settlement algorithms—constitutes proprietary trade secrets protected under the Defend Trade Secrets Act of 2016 (18 U.S.C. § 1836) and federal commercial laws of the United States. Reverse engineering, scraping, or disclosure of these proprietary mechanics to competing financial entities, banks, or payment processors is strictly prohibited.
2. Express Authorization for Viral Referrals: Notwithstanding the confidentiality obligations above, Affiliates and Merchants are expressly licensed and authorized to communicate the benefits, rewards, and referral links (e.g., ?ref=VIPER) to direct contacts, friends, drivers, and prospective merchants for bona fide commercial recommendation purposes.
Article VII: Non-Custodial BaaS Infrastructure & Partner Banks Disclaimer
CashGravity Global LLC operates solely as a software and technology provider (BaaS under NAICS 541511). CashGravity is not a bank, not an insured depository institution, and does not provide money transmitter or money services business (MSB) activities directly. All banking accounts, custodial deposits, and payment card issuances are provided directly by FDIC-insured member partner banks (including Mercury Bank, Choice Financial Group, Lead Bank, and Column N.A.) and licensed payment networks. Funds deposited into partner bank accounts are insured by the FDIC up to legal limits through sweep network arrangements.
Article VIII: Corporate Concierge Services (Legal & Tax Disclaimer)
CashGravity's Corporate Concierge features (including assistance with US LLC formation via Bizee, EIN registration with the IRS, and D-U-N-S profiling) are strictly automated administrative and technological facilitation tools. CashGravity is not a certified public accounting firm (CPA), nor a law firm, and does not provide legal, tax, or investment advice. Users and VIP merchants remain solely responsible for consulting their own legal and tax advisors regarding compliance with IRS Form 5472/1120 filing and FinCEN Beneficial Ownership Information Reporting (BOIR).

CashGravity does not sell, lease, or distribute customer contact data to third parties.
Article XI: Merchant KYC Verification, Lawful Data Processing & AML/CFT Safe Harbor (Dominican Laws 172-13 & 155-17)
In accordance with Article 27(4) of Dominican Law No. 172-13, consent is not required to process merchant and user identification records (ID/Cédula, Tax ID/RNC, physical location, WhatsApp contact, and payout bank details) that derive from a commercial or contractual relationship and are necessary for its performance, such as the contract required to clear funds. CashGravity applies to that processing the principles of Article 5 of the same law (lawfulness, quality, information and security) and the information-policy duties of Articles 41 and 42. Merchants warrant the authenticity of all submitted KYC data and assume exclusive legal, civil, and fiscal liability for transactions processed through their assigned Web POS. CashGravity Global LLC operates in full alignment with Law No. 155-17 (Anti-Money Laundering & Counter-Terrorist Financing) and US FinCEN regulations, maintaining immutable audit trails to ensure institutional safe harbor.

Official legal inquiries must be directed to legal@cashgravity.app.
Article XIII: Biometric Data Protection, Retention & 24-Hour Purge Policy (Dominican Law No. 172-13)
In strict accordance with Law No. 172-13 on the Protection of Personal Character Data of the Dominican Republic (Article 5, principles, and Article 13, duties of the data controller), all biometric data extracted during the physical eID NFC reading process—specifically the high-resolution facial portrait stored in EF.DG2 under ICAO Doc 9303—is processed exclusively in volatile memory (RAM) for real-time authentication and presentation.
24-Hour Purge & Zero Permanent Biometric Storage: CashGravity Global LLC does NOT store raw biometric photographs or facial templates in permanent databases or public cloud storage. Raw biometric payloads are irreversibly purged from volatile server memory within twenty-four (24) hours of authentication, or immediately upon session completion. The platform retains only a one-way cryptographic SHA-256 integrity hash and audit timestamp for anti-money laundering (AML/CFT) safe harbor.
Article XIV: Technology Service Provider (TSP) Delimitation & Financial Intermediation Disclaimer (Dominican Laws 183-02 & 126-02)
Under Dominican Monetary and Financial Law No. 183-02 and Law No. 126-02 on Electronic Commerce, Digital Documents and Signatures, CashGravity Global LLC operates strictly and exclusively as a Technology Service Provider (TSP / NAICS 541511) supplying cryptographic authentication, eID reader bridges, and e-CF digital signature software tools.

They are not directed to children, and CashGravity does not knowingly collect personal information from anyone under 13 years of age (Children's Online Privacy Protection Act, 15 U.S.C. §§ 6501-6506). During identity verification, the date of birth read from the document on the user's device is checked; if it shows that the holder is under 18, the verification stops and the images are discarded. If CashGravity learns that it holds personal information of a child under 13, it will delete it promptly. A parent or guardian who believes that a child has provided information may write to compliance@cashgravity.app. The processing of data of minors is also governed by Article 79 of Dominican Law No. 172-13 and the Code for the Protection of Children and Adolescents.

We will obtain the user's separate, affirmative consent to the automatic renewal and send a confirmation that includes the cancellation instructions. The user may cancel online at any time, through the same channel used to subscribe; cancellation takes effect at the end of the period already paid. We keep the record of the user's consent for at least three (3) years, or one (1) year after the plan ends, whichever is longer, and we give notice of a price change between seven (7) and thirty (30) days before it takes effect (California Business & Professions Code §§ 17600-17606; Restore Online Shoppers' Confidence Act, 15 U.S.C. §§ 8401-8405).
